Acceptance of Terms
These terms apply to any arrangement ("Agreement") for using www.mu-seek.com's web services and MU-SEEK Search Interface (further referred to as the "MU-SEEK Services" and as "Interface").
The Agreement is made between (1) the Customer (referred to as "You" or "Your") who visits MU-SEEK websites and/or downloads the Interface and (2) Us, Sloud Inc, as the owner of the Website, MU-SEEK Services and Interface (referred to as "We" "Us" or "Our").
By using the MU-SEEK Services and/or Interface, you are agree, without limitation to be bound by, and to comply with, these Terms and Conditions, which we may update without notice at any time. If you do not agree to these Terms and Conditions, please do not use MU-SEEK Services, uninstall the Interface, and do not access information from the MU-SEEK's websites.
MU-SEEK Services
The MU-SEEK Services are searchable database and web server designed for retrieve, selection and arrangement of lists of music by textual, non-textual and content-based musical queries.
The content on the MU-SEEK web sites, software and data (referred to as "Material") are copyrighted by us and protected by copyright laws. All music works are copyrighted by their rightful owners.
You may only access and use the Material for personal non-commercial purposes. You agree not to duplicate, reproduce, modify, publish, broadcast or distribute in any way any portion of the Material to any third party without our prior written permission.
The MU-SEEK Services are provided "as is", with no warranties whatsoever. We accept no responsibility for the completeness or accuracy of any of the information contained on or accessed through the MU-SEEK Services and makes no representations about its suitability for any particular purpose. We exclude all liability for loss or damage arising from the use of, or reliance on, the information contained on or access through the MU-SEEK Services whether or not caused by any negligence of us.
MU-SEEK Search Interface
The Interface is an MU-SEEK's search tool that allows you to create queries by tune example and to access directly to the MU-SEEK Services. The Interface is made available subject to a license agreement. By clicking the "I accept the agreement" radio-button during installation, or by using the Interface Freeware, you agree to be bond by the Interface's license agreement.
You may download or copy the Interface only for your personal non-commercial use. You may not disassemble, decompile, derive the source code of the Interface, modify, or create derivative works from the Interface. The Interface is provided on an "as is" basis and all use is at your own risk. We disclaim all liability arising from or relating to the Interface.
Confidentiality
We use cookies for remembering your name and password and preferences, tracking click streams, and for load balancing. Your use of the MU-SEEK Services will be logged for the purpose of security and usage monitoring. We use this information for purposes of security, to learn more about how the MU-SEEK Services are used, and to improve the quality and usefulness of it. All personal information provided by you including your name, password, e-mail address, postal address, telephone number and other personal data are used to benefit you and shall be treated as confidential and shall not be released to any third party.
Disclaimers of liability
YOU ASSUME ALL RISKS ASSOCIATED WITH USE OF THE MU-SEEK SERVICES, INCLUDING RISK OF YOUR COMPUTER, SOFTWARE OR DATA BEING DAMAGED BY ANY CAUSE ARISING FROM OR RELATING TO THE MU-SEEK SERVICES OR INTERFACE. WE MAKE NO REPRESENTATIONS AS TO THE ACCURACY, QUALITY, TIMELINESS, AVAILABILITY, OR COMPLETENESS OF THE INFORMATION, SOFTWARE, PRODUCTS, OR OTHER MATERIALS AVAILABLE THROUGH THE MU-SEEK SERVICES, AND YOU SHOULD NOT RELY UPON THEM. WE PROVIDE THE MU-SEEK SERVICES ON AN "AS IS, AS AVAILABLE" BASIS. YOU USE IT AT YOUR OWN RISK, AND WE ARE NOT LIABLE FOR ANY ERRORS OR OMISSIONS IN ITS CONTENT OR DELIVERY, OR FOR ANY FORM OF LOSS OR DAMAGE (INCLUDING ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, OR EXEMPLARY DAMAGES, EVEN IF KNOWN TO US) THAT MAY RESULT FROM ITS USE. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NO WARRANTY NOT SET FORTH IN THIS AGREEMENT WILL BE VALID. IF ANY OF THE ABOVE PROVISIONS ARE VOID UNDER GOVERNING LAW, OUR LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.
Complaints
Your satisfaction is important to us. If you are in any way dissatisfied with the service you receive or have any suggestions as to how that service might be improved, please contact us by email. We will then investigate the matter thoroughly and take whatever action we think appropriate.
